    What is workmen’s compensation?

    Workers’ compensation is a corporate form of insurance that provides wage replacement and medical benefits to employees who are injured at work.

    Workmen’s Compensation acts as a waiver for the employee’s right to sue his or her employer in the event of negligence. 



    Does Workmen’s Compensation it apply to you?

    The Compensation for Occupational Injuries and Diseases Act applies to:

    –          All employers and workers (casual and full-time), who are injured, disabled, become ill or are killed as a result of a workplace injury.

    This does not include:

    –       Domestic workers

    –       Workers who are in military training

    –       Members of the National Defence Force/ South African Police Service

    –       Workers who are partially disabled for less than three days.

    –       Workers who are employed outside of South Africa for more than 12 continuous months.

    –       Anybody guilty of wilful misconduct (unless disabled or killed).

    How do I submit my Annual Return of Earnings (ROE) to the Compensation Fund?

    Your ROE will be issued to you before the 31 January each year and must be completed in full.

    The Return of Earnings form must stipulate the following important information:

    –       Updated contact details of the employer (e.g. physical and postal addresses, telephone numbers, nature of business; etc.)

    –       Number of employers (workers) employed for the identified assessment period (1 March to the end of February)

    –       The nature of business of the employer


    It is important to note that it is the responsibility of the employer to ensure that they have been issued with the ROE and submit by the closing date mentioned above!

    The ROE (return of earnings) form (WAS.8) may be submitted in three ways:

    1.       Hand delivered to the Compensation Fund offices in Pretoria.

    2.       Hand delivered to the your nearest Labour Centre in any province of the RSA.

    3.       Posted to the following address:

    4.       Submitted online via the Department of Labour Online Services
